The Probate and Estate Administration Process

The probate process is in place to oversee the orderly distribution of assets upon death. When your loved one dies with a will in place, you must take the will to the probate court. The court will review the will and, once it confirms that it is valid and effective, it will open the estate and name an executor to administer it.

If your loved one dies without a will, his or her estate still needs to be administered. The court will appoint an administrator, rather than an executor, and will apply the state's laws of intestacy to identify heirs and determine the distribution of property.

Whether the terms of a valid will are applied or the estate is distributed under the laws of intestacy, the probate process includes:

  • An accounting of all of the assets of the estate, including life insurance policies
  • The valuation of assets, if necessary
  • The payment of all final debts
  • The payment of all tax obligations
  • The distribution of all assets
